These terms and conditions govern your use of our website. Please read these terms in full before you use this website. If you do not accept these terms and conditions, please do not use this website. Your continued use of this website confirms your acceptance of these terms.

Definitions

Seller means Grey’s Nishikigoi Ltd (Grey’s Koi)

Customer means the person or company to whom these Terms & Conditions are addressed.

1. General

These terms and conditions are applicable to Grey’s Nishikigoi Ltd and to the buyer hereafter referred as the Customer

2. Price

All prices are quoted in Pounds Sterling.

3. Payment

Payments must be made in Pounds Sterling only, and by one of the following payment methods.

·         Bank Transfer

·         Card Payments

·         Cash payments

4. Passing of property

Grey’s Koi shall retain the property of the goods until full payment has been made by the customer and has been received by Grey’s Nishikigoi Ltd.

5. Passing of risk

The risk in the goods shall pass to the Customer on delivery.

6. Delivery of Dry Goods

Delivery date:

Any date or period for delivery shall be considered as indicative only, although it is our policy to try to fulfil all orders within 3 working days. Any products not available at the time of your order will be sent to you, as soon as possible, when received from the manufacturer. Grey’s Nishikigoi Ltd, cannot be held responsible for delays in the delivery caused by the manufacturer, or any other third party.

7. Acceptance & Return procedure

Cancellation / Returns

If you wish to cancel your order, you can legally do so within 14 days of receipt of your products.  To do so please contact us at:  enquiries@greyskoi.com for authorisation and advise on best way to return such items.

Products are to be returned in perfect condition and done so at your own risk and cost.  

The products being returned must be securely packed to avoid damage, include contact information.  We recommend returning the products by recorded delivery.

We will refund all sums paid by you, less delivery charge.

Return of goods after 14 days is at our own discretion. Please contact us for further information.

Goods are not allowed to have been used or tested.

We process returns as quickly as possible.  Please allow 7-14 days for us to handle your product return.

This refund policy does not affect your statutory rights.

Damaged Items

If an item is damaged in transit or upon receipt of the goods, we must be notified immediately.

We must be notified as soon as possible about any fault / damaged items to ensure we can rectify this. 

We will ask for proof that the item was faulty when purchased IF you ask for a repair / replacement within 6 months. 

Warranty Returns Policy

Products that carry a manufacturer's guarantee can be returned, if faulty, to us for exchange during the warranty period.

If you feel the product is faulty, please contact us at:  enquiries@greyskoi.com for authorisation and advise on best way to return items to us.

Returning products is done so at your own cost and risk.

Upon receipt of the faulty product our returns team will test/inspect the product or send back to the manufacturer.  We aim to keep you informed along this process.

If the product is found to be faulty, we will ship a replacement via our courier at no extra charge within the UK.

8. Koi Purchasing Terms & Conditions

All Koi undergo our strict 6 to 8 weeks double heat ramp quarantine procedure.

Koi can be reserved by paying a 20% deposit, balance payable on collection within two weeks of reserving this koi unless otherwise agreed.

If a deposit or full payment has been made before collection, upon viewing the koi you may exchange for another koi or have a credit. 

Upon collection of a koi, the customer and Grey’s Nishikigoi Ltd are in agreement that the koi is in good condition and in good health before leaving our premises.  Once the koi has left our premises and is in the customers pond and care, Grey’s Nishikigoi Ltd are no longer responsible for the koi. 

Grey’s Nishikigoi Ltd will try their utmost to ensure female koi are sexed correctly.  In the unlikely circumstance if a koi sold as female and has left the premises and later is believed to be male sufficient proof will need to be required.  If said koi is proven to be male Grey’s Nishikigoi Ltd and customer will come to an amicable credit agreement.

Due to bio security under no circumstances can Koi be returned. 

9. Licence agreement

The Customer shall respect all licence agreements delivered by the copyright owners. Grey’s Nishikigoi Ltd cannot be held responsible or liable for any misuses conducted by the Customer or any third party.

10. Law

These terms and conditions are governed and shall be interpreted in accordance with English law.

11. Contract

Automatic confirmation of receipt of your Order does not constitute a contract between us. A contract for the Sale of Goods shall only arise on the despatch of the Goods to you.

Privacy Policy 

We are committed to ensuring the best standards of practice in all our activities. Visitors to our web site can be assured that the protection of privacy and confidentiality are given the highest priority. All personal information is collected, held and used in strict compliance with the General Data Protection Regulations 2018.

Information Collected

We do not collect any personal information from visitors to our website other than information that is knowingly and voluntarily given. Anonymous information is collected, such as the number of visitors to the website in a given period, but it is purely statistical and cannot be used to identify an individual user. Cookies are not used to collect any other information from visitors to the website. Visitors interested in requesting more information can provide contact details via a fill-in form. Visitors cannot be contacted unless such information is given. Visitors are also invited to give additional company information but a decision not to do so does not affect any subsequent negotiations or discussions.

Third Party Disclosure

We will NEVER pass any personal information on to any third party without your consent.

Data Security

We take appropriate measures to safeguard the information we hold from unauthorised access or improper use. Our database is stored in a secure, password protected location. Only users authorised by us have access to this data.

Integrity of Data

We take all reasonable measures to ensure that the information we hold is accurate. In particular we use reliable collection methods and destroy or convert to an anonymous form any out-of-date data. Individuals may request details of all personal information held by us so as to contest inaccurate or incomplete data, verify the information and have it corrected as appropriate.

Children

Our website is not targeted at children but in any event personal information will not knowingly be collected from children under fourteen years without parental consent.
